Lawyers for quarterback Colin Kaepernick have told the NFL whether they are asking some team owners, including Jerry McNair of Jerry Cowboys and Houston Texans, to participate in the deposition as part of Kaepernick's complaint accusing the owner and team of colluding to keep him out of the league, someone familiar with the case said Friday.

The request also seeks access to electronic communications, including email and text messaging, to which some teams associated with Kaepernick, according to the person, who spoke on condition of anonymity because Kaepernick complaints remain pending.

The NFL declined to comment. Some of the teams involved refused to comment or not immediately.

Kaepernick remains unsigned as he can get out of his contract with the San Francisco 49ers following last season. He started the movement of players who were doing the exercises while being temporary with 49ers last season. He was represented in a collusion complaint by Los Angeles-based Los J. Geragos lawyers, with the support offered by the NFL Players Association.

"NFL defense is NFL defense."

If the case gets to the hearing, it will be heard and resolved by Stephen B. Burbank, University of Pennsylvania law professor who resolves a dispute between league and player unions arising from their collective bargaining agreement.

Under the terms of the CBA, Kaepernick must prove the team conspire with each other or with the league. The fact he is not signed, does not in itself prove collusion, under agreement.

Jones has already said he will make a Cowboys player bench performing progress when the national anthem. McNair created a controversy as he felt saying in a recent owner meeting the NFL "can not have prisoners who are carrying out the prison."

Legal request Kaepernick law previously by other media, including CBS and ESPN. The report also mentions Jed York of 49ers, Paul Allen of Seattle Seahawks and Robert Kraft of the New England Patriots among the ousted owners, and Seahawks, Tennessee Titans and Baltimore Ravens among teams from where electronic communications are underway. searching for

Kaepernick visited Seahawks during the holidays but was not signed. Ravens secret meetings to sign it when the training camp when their starter, Joe Flacco, was training for a back injury, but he did not. The Titans exam Brandon Weeden and not Kaepernick in the season when starter Marcus Mariota was injured.

Kaepernick resigned from his contract with the 49ers but the team that said it partly defended it under the deal.

NFLPA no request to comment on Friday.

Legal experts say the case of collusion is hard to prove without a "smoking weapon" evidence the team conspired with each other or with the league.

"No Club, agent or agent to run or League of individual decisions," said CBA, adding that applies to "whether to negotiate or not negotiate with any players" and "whether to offer or not offer Player Contracts to any player," Between other.

The CBA also says: "The failure of a Club or Club to negotiate, Offer or Offer, or to negotiate, make an offer, or to a contract in question or an Unrestricted Free Agent, shall not by itself or not, likewise meet the established proof ... above. "
